With our digital incident form and after-incident upload checklist, your employees will be able to gather the most valuable information by just simply starting the form. Waivers are an important risk tool. A waiver is not just a “I promise not to sue” document. A modern waiver is a legal agreement by and between the FEC and the customer. The waiver will cover multiple points that are designed to add layers of protection to your business.

Legal Notice

Customers are invitees of your business and as such, they are entitled to a level of safety. They law calls this your duty of care.

What does that mean?

Your customers must be informed (put on notice) of the rules, warning and dangers. This is for all your attractions and place in or around your facility that need special attention such as uneven area of a miniature golf course.

Some times signs may not be enough. I like to use prerecorded safety messages that play though out the part.

What Actually Happened

You get a letter in the mail and its from an ambiance chasing attorney. The letter says their client was seriously injured 45 days ago. As you can imagine, the letter gives a drastically different account of events than what actually happened.

If you have poor coverage or bad video you are going to have a hard time defending your side of the events. Cameras should cover every attraction, entrance and exits of the build, busy or known problem areas and the parking lot. Storage capability of your system should be 30 days at a minimum.

Overview

Devices Covered:
Includes portable amusement rides. Excludes rides operated at permanent amusement parks. Some non-ride amusement devices installed at permanent parks may be subject to CPSC jurisdiction (e.g., trampoline courts, soft play).
Inspection Program: None
Investigative Authority:
The Consumer Product Safety Act (CPSA) authorizes the Commission to investigate serious accidents involving portable carnival rides, inflatables, and go-karts. Amusement rides operated at permanent parks are exempt from compliance with the CPSA.
Reporting Criteria:
A ride manufacturer or owner/operator is required to notify the Consumer Product Safety Commission if it obtains information which reasonably supports the conclusion that a portable amusement ride, inflatable device, go-kart or other non-exempt amusement device: (1) fails to comply with a consumer product safety standard or banning regulation established by the omission or a voluntary consumer product safety standard upon which the Commission has relied under section 9 of the CPSA; (2) contains a defect which could create a substantial product hazard described in section 15(a)(2) of the CPSA; or (3) creates an unreasonable risk of serious injury or death.
